Tallahassee Highland Games Waiver and General Terms and Conditions
Waiver and Release of Liability
I. Introduction:
These Waiver and Release of Liability Terms and Conditions apply to all events, including but not limited to the Tallahassee Highland Games, Team Tallahassee Sports Corporation events, and any other event or exposition hosted by the Organizer. By purchasing a ticket, attending, or participating in any event, activity, or experience conducted by Team Tallahassee Sports Corp and Tallahassee Highland Games LLC (hereinafter referred to as "the Organizer"), all attendees (hereinafter referred to as "Participants") agree to these terms.
II. Scope of Events:
The Organizer's events may feature a variety of activities, including music, dancing, athletic competitions, archery, and other physical tasks. Events may also provide opportunities for alcohol consumption. Participants are advised to engage in activities responsibly and understand that their participation in any event activity is entirely voluntary.
III. Express Assumption of Risk and Waiver of Liability:
A. Assumption of Risk:
By entering the event premises, Participants acknowledge and agree that they do so at their own risk and assume full responsibility for any risks of bodily injury, death, or property damage arising from or related to participation in these events, whether caused by the negligence of the Organizer or otherwise. This includes risks associated with physical activities, equipment use, and the behavior of other Participants.
B. Waiver of Liability:
Participants hereby release, waive, discharge, and covenant not to sue the Organizer, its officers, employees, agents, volunteers, partners, or sponsors from any and all liability to the Participant, their personal representatives, assigns, heirs, and next of kin for any loss, damage, or claim related to injury to person or property, or resulting in death of the Participant, whether caused by any negligent act or omission of the Organizer or otherwise. This release applies to events occurring on-site or at any off-site event location.
IV. Medical Consent and Authorization:
If a Participant is signing on behalf of a minor or an individual for whom they are legally responsible, the Participant grants permission for any person connected with the Organizer to provide necessary first aid and, in more severe cases, to call for medical and surgical care for the minor or individual and to transport them to an appropriate medical facility. The Participant agrees to be solely responsible for all medical expenses incurred on behalf of themselves or the minor/individual.
V. Compliance with Laws and Regulations:
Participants must comply with all applicable laws, statutes, ordinances, and regulations regarding their behavior and conduct at the event. This includes the responsible consumption of alcohol in accordance with state and local laws, and adherence to safety guidelines as instructed by the Organizer or event personnel.
VI. Service Animals and Accessibility:
Only service animals as defined by the Americans with Disabilities Act (ADA) are permitted on the premises. The Organizer is committed to providing accessible facilities and accommodations for all Participants in compliance with ADA guidelines.
VII. Prohibited Items and Behavior:
A. Prohibited Items:
Participants are prohibited from bringing illegal substances, weapons, or any items deemed dangerous or inappropriate by the Organizer onto the event premises.
B. Prohibited Behavior:
The Organizer reserves the right to refuse entry to or remove any Participant conducting themselves in a manner that is disruptive, dangerous, or potentially harmful to themselves or others, or that violates these terms and conditions.
VIII. Event Changes and Cancellations:
The Organizer reserves the right to make changes to the event schedule, activities, or terms, and to cancel or postpone events as necessary. In such cases, efforts will be made to inform Participants promptly. The Organizer is not responsible for any costs or expenses Participants may incur as a result of event changes or cancellations.
IX. Indemnification:
Participants agree to indemnify, defend, and hold harmless the Organizer, its officers, directors, employees, volunteers, partners, sponsors, agents, or representatives from and against any and all claims, demands, actions, lawsuits, damages, costs, or expenses, including attorney fees, arising out of or in any way related to their participation in or presence at the events, whether on-site or at any off-site location, including but not limited to claims of negligence.
X. Governing Law:
These terms and participation in any event hosted by the Organizer are governed by and construed in accordance with the laws of the State of Florida. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Florida.
XI. Electronic Acceptance and Compliance Agreement:
By purchasing a ticket, attending an event, or being present on-site or at any off-site event location, Participants agree to be bound by these terms and conditions, thereby waiving substantial legal rights. This waiver and release will be binding regardless of whether a physical or electronic signature is provided.
XII. Acknowledgment of Terms Upon Ticket Purchase and Presence:
By purchasing a ticket, attending an event, or being present at the event premises, including during setup or teardown phases, Participants hereby acknowledge that they have received, read, understood, and agree to the terms and conditions outlined in this Waiver and Release of Liability and General Terms and Conditions. Their ticket purchase, attendance, or presence signifies that they fully agree to be bound by these terms, even if they have not provided a formal signature.
